I was browsing thru the forza forums and there are already 2 "I've been banned" threads. I mean, REALLY?! THIS IS DAY 2 PEOPLE! DAY 2!

It could be them playing on a hacked Xbox... Newer games contact the central server (even without live) as long as there is a network connection. They check for Xbox OS hacks.

What do the Hacks do? They allow downloading and playing of FULL games to the Xbox for free. Once hacked, you should not stay connected unless your are downloading games; otherwise, you run the risk of getting shut down.

I have a few acquaintances that hack their consoles, so I'm pretty well versed on what they can and cannot do once hacked... It's really stupid if you ask me, but to each their own I guess...
